1. Acceptance of Terms
By using the services of NH Logistics (‘Company’, ‘we’, ‘us’, or ‘our’), you agree to be bound by these Terms of Service. These terms apply to all clients, users, and visitors who access or use our logistics and transportation services.
2. Services
NH Logistics provides transportation and logistics services including ODC transportation, full truck load services, container transportation, heavy machinery shifting, and related logistics services across India. The scope of services is defined in individual contracts or service agreements.
3. Bookings and Contracts
All service bookings must be confirmed in writing. A contract or service order is binding once confirmed by both parties. NH Logistics reserves the right to decline bookings that exceed our safety parameters or legal permit requirements.
4. Payment Terms
Payment terms are specified in individual service contracts. Advance payment may be required for certain services. Late payments attract a penalty of 2% per month on the outstanding amount. All prices are exclusive of applicable taxes.
5. Cargo Liability
NH Logistics takes reasonable care of all cargo entrusted to us. Our liability is limited to the declared value of goods as per the consignment note, up to a maximum as specified in the service agreement. We recommend clients obtain adequate cargo insurance for high-value shipments.
6. Client Responsibilities
Clients are responsible for: accurate cargo descriptions and declared weights/dimensions, obtaining necessary permits and NOCs, ensuring proper packaging and labeling, providing accurate pickup and delivery addresses, and being available at agreed times for loading/unloading.
7. Delays and Force Majeure
NH Logistics will make every effort to meet agreed delivery timelines. However, we are not liable for delays caused by traffic, weather, road conditions, natural disasters, strikes, government restrictions, or other events beyond our control.
8. Prohibited Cargo
We do not transport illegal goods, explosives, certain hazardous materials without proper permits, wildlife or wildlife products, or any goods prohibited under Indian law. NH Logistics reserves the right to inspect cargo and refuse transportation of prohibited items.
9. Dispute Resolution
Any disputes arising from our services will first be attempted to be resolved through mutual discussion. If unresolved, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996. The jurisdiction shall be Mohali, Punjab, India.
10. Changes to Terms
NH Logistics reserves the right to modify these terms at any time. Updated terms will be posted on our website. Continued use of our services constitutes acceptance of updated terms.
